1. Acceptance of Terms

By creating an account, accessing our website at buildability.us, or using any Buildability™ services ("Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

ReadyPermit.ai, Inc. ("Buildability™," "we," "us," or "our") reserves the right to modify these Terms at any time. We will notify users of material changes via email or through prominent notices on our website. Continued use of the Services after changes constitutes acceptance of the modified Terms.

2. Account Registration and Responsibilities

Account Creation

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years old or have parental consent

Account Security

You are responsible for all activities that occur under your account. Buildability™ is not liable for any loss or damage arising from your failure to maintain account security. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Service Plans and Billing

Subscription Plans

Buildability™ offers various subscription plans with different features and usage limits. Plan details, pricing, and features are available on our Pricing page.

Payment Terms

• All fees are in US Dollars and charged in advance
• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method on file for renewal
• One-time report purchases are non-refundable after report generation
• Purchased credits and credits included with Pro do not expire

Refund Policy

We offer a 14-day money-back guarantee on all new subscriptions. One-time report refunds are considered on a case-by-case basis within 7 days of purchase. Contact team@buildability.us with your account details and reason for the request.

4. Acceptable Use Policy

You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Services for any illegal, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to our systems or user accounts
• Reverse engineer, decompile, or disassemble any part of the Services
• Resell, redistribute, or sublicense access to the Services without permission
• Scrape, harvest, or collect data from the Services using automated means without API authorization
• Use report data or Buildability Score™ methodology to train competing AI models
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Services or servers
• Exceed API rate limits or abuse system resources

5. Intellectual Property Rights

Buildability™ and Buildability Score™ are trademarks of ReadyPermit.ai, Inc., with pending U.S. federal trademark applications (USPTO Serial Nos. 99668649 and 99668635). Geo™ is a trademark of ReadyPermit.ai, Inc. The Buildability Score methodology, including its versioned multi-factor weighted model (nine factors as of methodology v2) and jurisdiction-aware weighting system, constitutes proprietary trade secrets and intellectual property of ReadyPermit.ai, Inc. Unauthorized reproduction, reverse engineering, or commercial use of the scoring methodology is prohibited. Report content may be shared for personal or professional due diligence purposes but may not be resold, republished, or used to train competing AI systems without written permission.

License to Use Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes.

Generated Reports

You retain ownership of reports you generate using our Services. We grant you a perpetual, worldwide license to use, modify, and distribute your generated reports for personal or professional due diligence purposes. Reports may not be resold, republished commercially, or used to train competing AI systems without written permission.

Prohibited Uses and Competitive Restrictions

You may not, directly or indirectly, use the Buildability™ service, its outputs, reports, scores, narratives, methodology, data integrations, APIs, or interfaces to: (a) develop, operate, launch, or market a product or service that competes with Buildability™ or ReadyPermit.ai, Inc. in the zoning, permitting, buildability, or property-development intelligence space; (b) train, fine-tune, benchmark, or evaluate any artificial intelligence, machine learning, scoring, or decisioning system intended for use in that space; (c) reverse engineer, decompile, disassemble, or attempt to derive the Buildability Score™ formula, its weighting system, or its regional calibration; (d) scrape, crawl, harvest, or systematically extract data from our services by automated means without prior written authorization; (e) resell, sublicense, republish, or redistribute Buildability™ content or outputs outside the scope of your individual permitted use; or (f) use any Buildability™ trademark, brand element, product name, or confusingly similar designation in connection with a competing product, domain, repository, or marketing material. Paying customer status, employment by a partner platform, access through a reseller, contractor relationship, or any other commercial or non-commercial relationship with ReadyPermit.ai, Inc. does not grant rights beyond those expressly set forth in these Terms. Violation of this section constitutes a material breach and may result in immediate termination, disgorgement of gains derived from the breach, injunctive relief, and trademark and unfair-competition remedies, in addition to any other remedies available at law or in equity.

6. Legal & Data Disclaimer (v2026-04)

Service Description

Buildability™ provides software tools that analyze public records, government APIs, third-party data sources, and user-supplied information to generate zoning, buildability, and permitability insights for real property in the United States. Our Buildability Score™ is a composite property-feasibility indicator derived from nine weighted factors under the current published methodology (v2): zoning, flood, seismic, soil, radon, wildfire, utilities, terrain, and lot geometry. Our services are designed to complement — not replace — the work of local planning departments, licensed professionals, and official government processes.

No Guarantee of Accuracy

While we strive for accuracy and maintain our data integrations with care, Buildability™ does not guarantee that any information, analysis, score, or recommendation is accurate, complete, current, or suitable for any particular purpose. Zoning codes, building codes, environmental regulations, and municipal policies change frequently across more than 30,000 U.S. jurisdictions. Data may be incomplete, outdated, incorrect, or interpreted differently by the relevant authorities. Our data sources may be 30 or more days old at the time of report generation.

Not Professional Advice

Buildability™ is not a government agency, law firm, licensed appraisal firm, engineering practice, surveying company, environmental consulting firm, title company, or financial advisor. Nothing in our products constitutes legal, engineering, financial, tax, investment, or other professional advice. Our reports do not constitute and should not be used as: a professional real estate appraisal, title examination, boundary survey, Phase I or Phase II environmental site assessment, structural engineering opinion, geotechnical report, or investment recommendation. You should consult the applicable city, county, state, or other authority, and qualified licensed professionals (including land use attorneys, planners, civil engineers, surveyors, environmental consultants, and accountants) before relying on any output from Buildability™.

AI and Automated Systems

Our products use artificial intelligence ("AI"), including large language models from Anthropic (Claude Opus, Claude Sonnet, and Claude Haiku), and automated systems to process data and generate narratives, scores, and recommendations. AI outputs can be wrong, incomplete, inconsistent, or hallucinated. AI may misinterpret source documents, regulatory texts, or spatial data — especially where codes have recently changed, where underlying data is ambiguous, or where local interpretation differs from published text. We route each question to the appropriate Claude tier and surface confidence scores alongside outputs to help you assess reliability; we do not claim multi-model or multi-vendor consensus, and no AI system is infallible. You are solely responsible for reviewing and validating all AI-generated outputs before acting on them.

Third-Party and Government Data Sources

Buildability™ integrates data from federal agencies (Census Bureau, FEMA, USGS, EPA, USDA), state and county records, open geospatial data (OpenStreetMap), and commercial providers (Regrid, RentCast, Zoneomics). These agencies and providers may change, withdraw, update, or correct their data at any time without notice to Buildability™. We make no warranty regarding the availability, completeness, reliability, timeliness, or accuracy of any third-party or government-sourced data. Attribution and source information is provided with each report for your reference and verification.

Buildability Score™ Limitations

The Buildability Score™ is a composite indicator designed to support preliminary feasibility screening. It is not a guarantee of buildability, permit approval, zoning compliance, or project success. A high score indicates favorable conditions based on available data; it does not eliminate the need for professional due diligence, municipal verification, or formal permit applications. Score weights are adjusted by jurisdiction to reflect regional conditions (e.g., flood risk weighting in Florida, regulatory complexity in California), but these adjustments are based on general patterns and may not reflect every local nuance. The score should be used as one input among many in your decision-making process.

No Permit or Approval Guarantee

A favorable Buildability Score™ or positive report finding does NOT guarantee permit approval, zoning compliance, or entitlement success. Permit issuance remains at the sole discretion of local authorities and may be affected by: variance requirements, code amendments enacted after report generation, policy changes, community input and opposition, environmental conditions discovered during construction, staff interpretation of ambiguous code provisions, or discretionary review processes. Always submit formal applications and obtain official written determinations from the relevant jurisdiction before commencing any work.

Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, ACCURACY, COMPLETENESS, OR RELIABILITY. READYPERMIT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Market and Financial Data

Market data, comparable sales, valuations, rental estimates, and economic indicators provided through our services are historical in nature and do not predict future real estate market performance, property values, rental income, or investment returns. Automated Valuation Models (AVMs) are estimates based on available data and may differ significantly from professional appraisals or actual transaction prices. Do not rely on this data for investment decisions, tax planning, or financial commitments without consulting a licensed financial advisor, CPA, or investment professional.

User Responsibility and Limitation of Liability

By using Buildability™, you acknowledge that you use our tools at your own risk and that you remain solely responsible for all decisions, transactions, investments, and actions you take based on or in connection with our services. To the maximum extent permitted by applicable law, ReadyPermit.ai, Inc. and its officers, directors, employees, contractors, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of (or inability to use) our products, even if we have been advised of the possibility of such damages. In no event shall our aggregate liability exceed the greater of the fees you paid to Buildability™ in the twelve (12) months preceding the claim or five hundred U.S. dollars ($500).

Relationship with Government Agencies

Buildability™ is an independent private company. We are not affiliated with, endorsed by, or acting on behalf of any federal, state, county, or municipal government agency. Our reports cite government data sources for transparency, but the inclusion of government data does not imply government endorsement or approval of our products or conclusions. We encourage all users to verify our findings with the relevant planning department, building department, or other authority having jurisdiction. We believe better access to public data helps property owners, communities, and local governments make better decisions — and we are committed to supporting that goal.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ReadyPermit.ai, Inc. and its officers, directors, employees, contractors, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of (or inability to use) our products, even if we have been advised of the possibility of such damages.

In no event shall our aggregate liability exceed the greater of the fees you paid to Buildability™ in the twelve (12) months preceding the claim or five hundred U.S. dollars ($500).

8. Indemnification

You agree to indemnify, defend, and hold harmless ReadyPermit.ai, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

9. Termination

Either party may terminate this agreement at any time. You may cancel your account through your account settings or by contacting team@buildability.us. We may suspend or terminate your access to the Services immediately if you violate these Terms.

Cancelling a subscription stops renewal but does not delete your account or generated reports. Deleting your account through Account Settings removes the account and user-owned data immediately and irreversibly, except records we must retain for legal, tax, fraud-prevention, or financial-compliance purposes.

10. Dispute Resolution

These Terms are governed by the laws of the State of Delaware without regard to conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in Delaware, administered by the American Arbitration Association under its Commercial Arbitration Rules.

You agree to resolve disputes on an individual basis. Class actions and class arbitrations are waived. Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction for violations of intellectual property rights.
